1- Services
VoIP.IT provides subscription-based Voice over Internet Protocol (VoIP) communication services to individuals and businesses. Services may include voice calling, messaging, conferencing, virtual Fax, and related telephony functionalities. Hardware products such as ATA devices, IP phones, and PBX systems are also available for purchase.
VoIP.IT delivers services primarily in Canada and the United States, but may serve customers in other regions where permitted by local telecommunications regulators.
2- Eligibility
You must be at least 18 years old and possess the legal authority to enter into a binding agreement to subscribe to or use VoIP.IT Services. You are responsible for complying with all local laws governing VoIP usage in your jurisdiction.
3- Account Registration
To use VoIP.IT Services, you must create an account and provide accurate and current personal or business information. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
VoIP.IT reserves the right to suspend or terminate any account found to be providing false, misleading, or incomplete information.
4- Subscription Plans and Billing
Services are provided on a subscription basis and may require an advance “setup” payment. Subscription fees, taxes, and equipment charges are outlined at the time of signup or purchase.
- Subscription terms (monthly, yearly, or custom) renew automatically unless cancelled before the renewal date.
- Payment methods accepted include credit card, PayPal, or approved business invoicing.
- The Advance and Premium Residential Plans include up to 3,500 incoming minutes each month, equivalent to about 58 hours of talk time from incoming calls. If you go over this limit, you'll get a notification that your Residential plan might need to be upgraded.
- Additional payphone surcharges may apply due to fees from upstream carriers; these could be billed retroactively. Customers are responsible for all charges.
- Toll-free usage is allowed if it does not represent a significant portion of traffic; accounts must maintain a 2:1 ratio of regular to toll-free calls.
- Porting your telephone number is included in your Residential plan. If your number porting submission is rejected, a $12 resubmission fee will apply. A $75 cancellation fee applies if you cancel after submission. Expedited number porting may be available – please contact us. A $35 port-out fee will apply to any number purchased solely to port away.
- Late or declined payments may result in suspension or termination of Services.
All fees are non-refundable, except as required by applicable consumer protection laws.
5- Equipment Sales
VoIP.IT sells compatible communication hardware, including ATA devices, IP phones, and PBX systems (“Equipment”). Ownership of the Equipment passes to the Customer upon full payment, unless it is part of a subscription or promotional plan.
Warranty:
Manufacturer warranties apply to all new Equipment sold by VoIP.IT unless otherwise stated. VoIP.IT is not responsible for manufacturer defects, but will assist customers in processing warranty claims when applicable.
Returns and Cancellations:
- Customers may return Equipment purchased directly from VoIP.IT within 30 days of purchase if the Service is cancelled, provided the Equipment is in its original condition with all packaging, accessories, and documentation. Returned Equipment must not show signs of misuse, damage, or modification.
- Refunds will be issued minus shipping costs, applicable restocking fees (usually up to 15%), and any non-refundable activation or setup charges. VoIP.IT reserves the right to refuse returns for equipment that does not meet these criteria.
- Equipment provided under rental or installment programs must be returned upon Service cancellation, or the remaining balance becomes immediately due.
VoIP.IT is not liable for Equipment compatibility issues with third-party software or configurations not approved or documented by our technical team.
6- Use of Services
You agree to use the Services in compliance with all applicable local, provincial, state and federal laws. You must not use the Services:
- To engage in fraudulent, abusive, or illegal activities.
- To send unsolicited or bulk communications.
- To harass or harm others.
- In any manner that disrupts or degrades network performance
VoIP.IT may suspend or terminate service if misuse or regulatory non-compliance is detected.

7- Emergency Services
VoIP.IT supports Enhanced 911 (E911) only available in Canada and the United States.
Enhanced 911 (E911) is an essential safety feature that provides peace of mind during emergencies. By automatically transmitting precise location details to emergency responders, E911 ensures that help arrives quickly and accurately when it is most needed.
Emergency dialling is NOT available, at this time, to customers outside of Canada and the United States.
8- Recordings and Transcriptions
The laws on call recording vary; Customer is solely responsible for compliance. Company is not liable for claims related to recordings.
By using transcription, Customer consents to processing data by third-party providers, potentially in other countries.
9- Service Availability and Maintenance
Our services maintain geographic redundancy, real-time traffic monitoring, and redundant data center infrastructure in North America and Europe. VoIP.IT and its network partners have a historically reliable uptime, but it does not guarantee uninterrupted service. VoIP.IT disclaims liability for service interruptions caused by third-party networks, ISPs, or power outages.
Our maintenance policy is focused on minimizing customer impact while performing essential upgrades, security patches, or emergency fixes across our infrastructure. Most maintenance procedures are designed so that inbound/outbound calls are automatically rerouted.
10- International Use and Regulatory Compliance
Use of VoIP.IT Services outside Canada or the U.S. is subject to that country’s telecommunications regulations. The Customer is responsible for ensuring compliance with such laws. VoIP.IT reserves the right to deny service where prohibited or restricted by local authorities.
11- Data Protection and Privacy
VoIP.IT handles all personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and other relevant privacy laws.
Our Privacy Policy, published separately, governs the collection, use, and disclosure of user data.
12- Cancellation and Termination
You may cancel your subscription at any time by contacting VoIP.IT Support. Cancellations become effective at the end of the current billing cycle unless otherwise specified.
VoIP.IT may terminate or suspend your Services immediately if you:
- Violate these Terms,
- Fail to pay required fees, or
- Engage in activities detrimental to service integrity or network security.
13- Liability and Disclaimers
VoIP.IT provides the Services “as is” and disclaims all warranties, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
Under no circumstances shall VoIP.IT be liable for indirect, incidental, or consequential damages arising from use or inability to use the Services, including loss of revenue, data, or goodwill.
14- Indemnification
You agree to indemnify, defend, and hold VoIP.IT, its officers, employees, and affiliates harmless from any claims or damages arising out of your use of the Services, breach of these Terms, or violation of any law or third-party rights.
15- Modifications to Terms
VoIP.IT may update or modify these Terms periodically. Changes will be posted on our website with an updated effective date. Continued use after such changes constitutes acceptance of the revised Terms.
16- Governing Law and Jurisdiction
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes shall be resolved in the courts located in Toronto, Ontario.
